Terms of Service

1. The Service

TrainSMS provides AI-generated fitness and nutrition guidance delivered via SMS. When you sign up, you receive a personalized training program built from the information you provide. Workouts are delivered to your phone each morning at the time you choose.

TrainSMS is not a licensed personal training service. It is an AI tool that generates programs based on your inputs. Trainers do not individually review or prescribe your workouts unless you are enrolled under a human coach.

2. Subscription

• Annual plan: $9.99/month, billed annually at $119.88.
• Monthly plan: $14.99/month, billed monthly.
• Charges appear on your statement as "TrainSMS" via Stripe.
• Cancel anytime: Log into your account or reply STOP to any message. Cancellation takes effect at the end of your current billing period.
• No refunds for partial months. Annual plan cancellations retain access until the end of the annual term.

4. Assumption of Risk

Physical activity — including the exercises described in your workout program — carries inherent risk of injury. By using TrainSMS, you:

• Acknowledge that you are participating voluntarily in physical activity.
• Represent that you have received clearance from a physician before beginning any exercise program.
• Accept full responsibility for any injury, illness, or other harm that results from following the workouts we send you.

5. Results Not Guaranteed

Every person's body, experience level, and response to training is different. TrainSMS does not guarantee specific results — weight loss, muscle gain, improved performance, or any other outcome. Your results depend on consistency, effort, recovery, nutrition, and individual factors outside our control.

6. Your Responsibilities

• Provide accurate health information during signup. Omitting relevant medical history may result in an unsafe program.
• Consult your physician before starting any new exercise or nutrition program, especially if you have pre-existing conditions, injuries, are pregnant, or are recovering from surgery.
• Report injuries or health changes to your physician — not to TrainSMS support — as your primary source of guidance.

7. SMS and Communications

• By signing up, you consent to receive SMS messages from TrainSMS at the phone number you provide.
• Standard message and data rates from your carrier may apply.
• To opt out: reply STOP, CANCEL, UNSUBSCRIBE, or HELP to any message. Opt-out is processed immediately.
• After opting out, you can re-subscribe at any time by visiting /start.

8. Intellectual Property

The training programs, workout content, and materials generated by TrainSMS are for your personal use only. You may not copy, redistribute, sell, or otherwise transfer content generated by the service to third parties.

9. Termination

We may suspend or terminate your account at any time if you violate these terms or if we believe your use poses a safety risk. You may cancel your subscription at any time through your account settings or by replying STOP to any message.

10. Limitation of Liability

TrainSMS is provided "as is" without warranties of any kind. We make no guarantees about the accuracy, safety, or effectiveness of the AI-generated programs. To the maximum extent permitted by law, TrainSMS and its operators shall not be liable for any injury, damage, or loss arising from your use of the service.

11. Governing Law

These terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved in the courts of California.

12. Changes to These Terms

We may update these terms from time to time. If we make a material change, we will notify you by SMS or email at least 14 days before the change takes effect. Continued use of the service after the effective date constitutes acceptance of the updated terms.
